Constitutional Precepts

Article 28. - "Every person has the right to access information on himself/herself or his/her property, contained in official or private records (...), to know the purpose for which the data was collected and how it is being used, and to request, before the competent court, the update, rectification or erasure of any records that are erroneous or unlawfully affect the petitioner's right. In addition, he/she will be able to access documents of any nature that contain information whose knowledge is of interest for communities or groups of people (...)."

Article 60. - "Every person has the right to protect his or her honour, private life, intimacy, self-image, confidentiality and reputation. The law will limit the use of computers (...)".

Article 281. - The following are functions of the ombudsman:

  • 3. To file unconstitutional actions, legal protection, habeas corpus, habeas data and any other actions or motions necessary in order to exercise the powers indicated above, where appropriate, as dictated by the law
